Fort Lauderdale, Florida, November 20, 2024 – Donnahue George, a licensed private investigator and lawyer, filed a notice of appeal (Case No. 21-cv-61719-KMM) with the U.S. Court of Appeals on November 12, 2024. George argues that the U.S. District Court for the Southern District of Florida wrongly dismissed his lawsuit against Ken Griffin, Citadel LLC, Robinhood Markets, Inc., the Depository Trust & Clearing Corporation (DTCC), and the Financial Industry Regulatory Authority (FINRA) on November 4, 2024.
George’s lawsuit alleges a conspiracy to manipulate the stock prices of AMC Entertainment Holdings, Inc. (AMC) and GameStop Corp. (GME) through actions such as naked short selling and market manipulation, violating U.S. RICO, antitrust, and monopoly laws.
The complaint, filed September 7, 2021, claims the defendants engaged in fraudulent schemes that damaged the financial markets, specifically harming retail investors, pension funds, and compliant institutions. The defendants allegedly profited significantly by artificially suppressing AMC and GME stock prices.
George’s appeal contends the district court erred in dismissing the lawsuit with prejudice.
“Is this case truly about my disbarment nearly 20 years ago for abandoning my practice to care for my mother in the Dominican Republic? Or is it about the wealthiest individuals exploiting loopholes to defraud everyday investors?”, George asked. “The victims’ letters submitted to the court should make clear what matters. No one, regardless of wealth, should be above the law,” he concluded.
Key arguments in the appeal include:
- The district court failed to address procedural flaws in the defendants’ dismissal motions.
- The district court incorrectly dismissed the complaint for insufficient claims.
- The district court wrongly characterized the complaint as a “shotgun pleading,” lacking clarity and proper notice to the defendants.
George seeks a reversal of the district court’s decision and a hearing on the merits of his case.
